《監(jiān)獄來的媽媽》主演服刑期間就參演？律師解讀

近日，電影《監(jiān)獄來的媽媽》引發(fā)爭議。

公開信息顯示，該電影定檔今年5月30日。電影宣傳文案強調(diào)“真實故事改編”“原型人物真實出演”，但有網(wǎng)友指責其美化犯罪行為。

此前，該電影主演趙簫泓曾發(fā)微博稱自己入獄10年。5月19日，趙簫泓的社交平臺賬號顯示“因違反法律法規(guī)或《微博社區(qū)公約》被禁止關(guān)注”。

此外，有網(wǎng)友發(fā)布圖片稱，趙簫泓的短視頻平臺賬號主頁顯示“該用戶被禁止發(fā)布作品”。5月19日，記者根據(jù)相關(guān)信息進行搜索，發(fā)現(xiàn)無法找到相關(guān)賬號。

Promotional materials for the film described it as "based on a true story" and featuring "real people portraying themselves", prompting backlash from some online users. Zhao Xiaohong, the film's lead actor, previously revealed on social media that she served a 10-year prison sentence.

On Tuesday, Zhao's Weibo account displayed a notice stating that it had been restricted for violating laws, regulations or community rules. Her account on a short-video platform also appeared inaccessible.

據(jù)大河報消息，電影編劇秦曉宇曾表示，趙簫泓監(jiān)獄服刑期間，就參與了拍攝。

秦曉宇在接受采訪時表示：其是從2018年6月開始籌備，為獲得批準進入監(jiān)獄采訪拍攝，做了許多申請和辦理手續(xù)的工作，最后得到了司法部相關(guān)部門的批準與支持。最初的想法是拍攝關(guān)于監(jiān)獄的紀錄片，通過真實的影像來記錄真實的監(jiān)獄、真實的獄警和服刑人員。

Screenwriter Qin Xiaoyu told Chinese media that Zhao participated in filming while still serving her prison sentence. Qin said the project began in 2018 and received approval from departments under China's Ministry of Justice to film inside prisons.

服刑人員能否參與商業(yè)電影拍攝？對此，北京安劍律師事務(wù)所周兆成律師表示，原則上絕對禁止，僅允許非商業(yè)性改造相關(guān)活動。《監(jiān)獄法》明確，監(jiān)獄所有活動必須服務(wù)于教育改造目的，不得用于商業(yè)盈利。這起事件中，趙簫泓于2019年拍攝時仍處于服刑期，擔任商業(yè)電影主演并參與盈利性發(fā)行，明顯超出法律允許范圍。

Legal experts have questioned whether a serving inmate can legally participate in a commercial film production. Zhou Zhaocheng, a lawyer at An Jian Law Offices in Beijing, said Chinese law generally prohibits prisoners from taking part in profit-making film projects, allowing only non-commercial activities related to rehabilitation and education.

如果報備紀錄片，實際拍商業(yè)片是否違法？周兆成表示，監(jiān)獄拍攝實行嚴格審批制，所有進入監(jiān)獄的拍攝活動必須提前報備目的、內(nèi)容和用途，且必須與審批一致。假如制作方最初以“拍攝監(jiān)獄教育改造紀錄片”申請司法部審批，實際卻將素材用于商業(yè)故事片制作，既違背了審批的公益目的，也違反了監(jiān)獄管理的強制性規(guī)定，擾亂了正常監(jiān)管秩序。

He added that if producers obtained approval to shoot a documentary but later turned it into a commercial feature film, it could violate prison management regulations.

另據(jù)荔枝新聞消息，5月18日下午，片方回應(yīng)稱，因輿情發(fā)酵，正與上海電影局協(xié)商調(diào)整檔期，上映時間暫未確定。

The production team said on Monday that it was discussing a possible release delay amid the growing controversy, adding that a new premiere date had not yet been decided.
